I think the BK Court may look more favorably on an offer that allows existing shareholders to participate in the reorganized company. From the Fiber Optek press release:

"Fiber Optek and its president, Michael Pascazi, said they are shareholder of Global Crossing and believe that stockholders should be included in the capital structure of a reorganized company."
