The act - since expired - had three criteria by which a special prosecutor was called upon... one of which was a substantial APPEARANCE of a conflict of interest.

I think that appearance is certainly there, otherwise why would the AD and the entire Texas staff have felt the need to recuse themselves?

Of course, the fact that the 'crooked E' was the main contributor to Dubbya throughout his entire political career has nothing to do with that 'appearance' of a conflict :)

If that isn't a substantial appearance of a conflict of interest, than there is no such thing.
