(TSE:MDS - news; NYSE:MDZ - news), together with their Applied Biosystems/MDS Sciex Instruments partnership, today announced that the Federal District Court in Wilmington, DE has ruled in favor of Applied Biosystems and MDS Inc. in a patent infringement lawsuit against Micromass U.K. Ltd. and its U.S. subsidiary, Micromass, Inc., both divisions of Waters Corporation. The Micromass Quattro Ultima(TM) systems, including the MassTRANSIT(TM) version introduced in March 2001, were found to infringe U.S. Patent No. 4,963,736. The patent covers technology for triple quadrupole mass spectrometers. The jury awarded damages in the amount of $47.5 million to Applied Biosystems and MDS Inc. The lawsuit was originally filed on February 18, 2000. The court is expected to meet next week to enter the final judgment.
