I wouldn't call it moderate the user speed, but rather the user expectation. You tell the user that his speed is 80K and I don't think he gonna complain if he got 800K instead(that is when the networks is not busy).

But, they will probably be on the phone to you complaining about their speed is only 80K when it used to be 800K! (Go ask Cable Modem subscribers). The speed of the user experience has many other factors beside raw transfer speeds. OS Type/ Browser Type/ Video Card Type/ CPU Type/ Buss Speeds,etc. There is no reason why the moderation of end user apparent data rates can not be controlled by the Subscriber Equipment.

Go look at Soma (1XEV based). When signing up for service options, you can select either MDR, or HDR data rates . Now we know that the wireless network is capable of delivering at the HDR rates at all times. But, the level of speed presented to the user is moderated by the subscriber equipment to provide a Quality of Service equiv. to what the subscriber requested.
