Microsoft attorney Richard Pepperman attempted to show that RealNetworks remained a dominant presence in the market.

He cited an internal RealNetworks' e-mail outlining a public-relations plan aimed at countering a March 19, 1999 Wall Street Journal story that said Microsoft was beginning to pose a serious threat to RealNetworks' market position.

The e-mail, addressed to Glaser and copied to Richards and other executives by a RealNetworks spokesman, emphasized the need to remind reporters of the company's "leadership position" and demonstrate its "impenetrable market position."

Richards said he never agreed with the statement that the company held an "impenetrable market position."

He said the document was part of a brainstorming session and that market share data and other figures it cited amounted to "straw man type of information."

Richards is the third witness to appear on behalf of the nine states that refused to sign on to an antitrust settlement between Microsoft and federal trustbusters. Cross-examination will continue Thursday. The trial is expected to run as long as two months.
