I guess that depends on what your philosophy of justice is. Assuming deterrence is not a factor (either this is a one off crime that no one will ever commit again, or you are sure that any punishment will have no deterrence effect) what is the justice of punishment. Is "an eye for an eye" just or is it just revenge if deterrence is not a factor? Or to phrase it another way is there a need for punishment even when deterrence does not need to be considered?

I might provide an answer later but I would like to see a few opinions from other people first.
