What I'm hearing from LL on this is that, with the death penalty, there is no chance of recidivism. I believe he also maintains that those released from prison have a high rate of recidivism, and that therefore the prison system isn't working. That argument ignores those who spend their entire lives in prison, and therefore have no chance to relapse into their criminal pasts. My preference would be to encourage states to seek out the most successful systems and emulate them or incorporate the successful aspects of them.
