George; In this country a contract is a contract, BORL has made a public offer, and I presume there are penalties if they step away from the deal, particularly in view of the fact that it is BORL's stock that dropped from 21 to 7. If you are smart, what you do is buy OPEN at 5 since you know that by the end of the summer you will get at least $6.35/share. A 30% return. BORL also reiterated recently that the deal is on with the lower collar (probably during the negotiations they put up the higher collar and seduced OPEn stockholders that they will probably get the higher collar. So OPEN's investors are not too happy either.
