I am only speculating on the logic that before OFDM could be at a level of development necessary for wide scale commercialization, 3G CDMA and WCDMA should be fairly well established. Hence, unless operators want to build out a completely new network alongside the existing CDMA based systems with no ability to cross-over to existing systems, they will have to develop multi mode chips and base stations, for backwards compatibility issues, and thus step on QCOM patents along the way.
