Cosmetic changes matter enough that people will try to pass laws with only cosmetic changes, or very minor non cosmetic changes even after a similar law was struck down as unconstitutional. I think if it opposed by other parts of our government besides the courts as unconstitutional then the argument that it is unconstitutional will have a slightly more powerful position in the market place of ideas. Those ideas eventually impact the court.
