Jovin Ruling Appealed

NEW HAVEN -- The city Friday appealed a state Freedom of Information Commission order to make public much of its file on the unsolved 1998 killing of Yale University student Suzanne Jovin.

The appeal, filed in superior court, argues that unveiling the Jovin file "would risk death or serious bodily injury to potential witnesses and informants."

The city also claimed the ability of law enforcement to apprehend Jovin's killer would be compromised.

In February, the Freedom of Information panel unanimously voted to order much of the 4,500 page-plus investigative file released, ruling the police department and city failed to prove why the documents should be exempted from disclosure.

The Courant and Jeff Mitchell, a childhood friend of the only named suspect, James Van de Velde, had filed complaints with the commission seeking access to the file. Van de Velde, Jovin's thesis advisor, has never been charged with the crime.

The city also filed a related legal action Friday, asking the court to stay release of the Jovin documents until the appeal is adjudicated.

The appeal charges the commission exceeded and abused its authority.
