At first I thought you were joking. But then I realized, so I went back and took scar face off "ignore".

This is the salient line in the article he posted:

"The court said state law was designed to mirror federal law, which bars an indirect purchaser from making such claims. "

I know this suit, that is to say this type of suit was brought to me circa 1998. This was originally a contract suit claim that the price of the windows operating system should not be paid because the purchaser did not use it.

But the license says that the end user must not use it at all to get their 50 bucks back. If they use windows 98, they lose the 50. But that contract is with the VENDOR, not MS.

When the main case came down all these guys amended to try to take the antitrust bad press to make what is a contract suit into an anti trust suit. The court did not buy the argument.

I AGREE WITH THE COURT DECISION, NOT BECAUSE IT IS PRO MICROSOFT, BUT BECAUSE IT IS GOOD LAW.

Third party beneficiary law is an area with which I am familiar, as is anti-trust. This court applied the law correctly.

If MS wins one they should not, based on some damn social political theory, rather than the law, I will be the FIRST to tell you.
