I know what you're saying, but it is hard to imagine that anyone could be so inept. Cover up or not? The trail of cookie crumbs was too easy to find.
1 Why didn't Crisp delete all his records? If he did it, noone would be able to prove the actual intent claim modifications (to match what is discussed in jedec, and what is in the ieee specs for ramlink).
2. The records kept at the June 92 BOD meeting, it boggles one's mind to have Tate actually discuss an 'action plan' to deliberate decide what claims to modify to match jedec's ratified memory. How inept can one be? At least destroy all copies of the notes there. Or why knowingly bring up deliberate fraud in a BOD meeting. Don't these guys have any common sense? Ergo, he didn't know he was discussing an action plan for fraud. Silly man.
3. What engineer-lawyer email from '92 would still be kept? And to have the engineer point to which modified claims matched what area of ramlink and sdram before they filed. That was incredibly dense.
This is why I don't think there was any cover up, the evidence was in plain sight, I don't think they even had any idea what they were doing was fradulent. Amateurs.
Come to think of it, BOD meetings are supposed to have the company lawyer sitting in. If the rmbs company secretary (a lawyer) was not asleep, he/she should have immediate moved to purge Tate's words from the records of the meeting. With all that warning about equitable estoppel, come on man, it just made no sense that record of this 'plan' would be kept around.
So, there you have it, no intent to defraud, just a bunch of inept amateurs not realizing that they were committing a crime, hence no real attempt to cover up. The shredding and burlap sack if done properly would not have so much evidence left behind, hence I doubt if there was a deliberate coverup.
Tate's life must be hell right now if he realized had he done a few small things, there would be no way to make a case. I hope some analyst will ask questions about these allegations. I'm sure the trial lawyers will be attending to hear carefully what rmbs management will say just in case they have a few more choice bits they can use in their trial.
