oil isn't really wasted if the oil company doesn't pay enough for the drilling rights

The term for that is theft. The plan by Kay Bailey Hutchison to grant the oil companies crude at less than market price is no different than if she gave away federal buildings, or currency from the central reserve. It's common property given to friends in return for favors.
