Chancery Judge Orders Deutsche Deposition In Hewlett Suit

PALO ALTO , Calif. -(Dow Jones)- A Delaware Chancery Court judge ordered Deutsche Bank investment adviser Dean Barr to give a deposition in the lawsuit contesting Hewlett-Packard Co .'s (HWP) planned merger with Compaq Computer (NYSE: CPQ - news) Corp. (CPQ), legal documents say.

Deutsche Bank had previously been "unable to assure us" Barr would grant a deposition, according to a letter submitted to the court Friday by an attorney for dissident board member Walter Hewlett.

Hewlett opposes the merger and has asked the court to overturn a proxy vote narrowly approving the $19 billion combination. In a suit filed last month, he argues that H-P management inappropriately induced Deutsche Bank to switch its vote on more than 17 million shares at the last minute to favor the merger. The votes, he argues, were enough to sway the outcome....
