Jon - did you read through the references I posted? The people on the front lines at the time don't see it as clearly as you appear to do.

Jobs accused Microsoft of using the MAC code they had access to, in the design of Windows 1.0; Microsoft responded by saying OK, can we license it and put this behind us? Apple says OK. Does that mean MS stole code, or simply wanted to avoid a fight? In any event, the court later determined that so many people were using the ideas that Apple was claiming, and there was so much prior art, that the Apple claims did not hold up.

There are many who ascribe to your view. Many who do not. I don't, but then I was working under contract for MSFT on code for OS/2 in the mid-80s, so my view is not untainted. That's why I put up the references - there is no clear cut story here, and both my position and yours are just opinions in the light of that set of independent historical views.
