Wrong again, herbie, Jerry is testifying as an expert in the field, not as a legal scholar, he does not have to read the states' suggestions, he can testify as to what he knows.
The fact that the states' attorney had 4 days and 400 questions for him on "The Rule Against Perpetuties", is that attorney's problem.
Jerry pulled the legal equivalent of a "Student Body Left" and that is perfectly acceptable and in fact if truth be know, kind of cute. :)
As far as the "exchange", that is YOUR testimony, not his. He just said, I tried, but here I am testifying ANYWAY, muchos believadabbles.
