"Varian Medical Can't Collect $775,000 Judgment During Appeal By Pham-Duy Nguyen San Jose, California, April 17 (Bloomberg) -- "Varian Medical Systems Inc. can't collect a $775,000 jury award from two former workers who are appealing the ruling that they defamed the world's largest maker of cancer-therapy radiation machines. A San Jose jury in December found Mary Day and Michelangelo Delfino guilty of defamation for making derogatory comments about Varian Medical officials and ordered them to pay a total $775,000. The former Varian scientists are among the first to defend themselves in court against accusations that they defamed people on the Internet. Palo Alto, California-based Varian sued the couple in 1999, accusing them of damaging the reputation of the company and its executives by posting false statements on their Web sites. Under the temporary stay granted by a California appellate court, Day and Delfino can continue to post comments about Varian officials on the Internet, Delfino said.
