You make the arbitrary assumption that whatever resource is being protected by the regulation is of no importance, or that it might as well be given away to anyone on a first grab first run basis.

1 - Again, many regulations do not protect resources. In fact a number of them waste resources.

2 - Keep the regulations that are most effective for the least costs (both direct government cost, and complience costs), and you can protect a whole lot for less then we now spend. You can probably protect even more as the regulations are more efficently targeted.
