You are analogizing to a court of law, which the UN is not. Relationships between nations are not governed by statutes, but by treaties, and international law.

You apparently have no respect for the UN, but it appears to me that Israel respects the UN well enough to remain a member.

At any rate, the simple thing to do is for Israel to send along its own investigators, to work in tandem with the UN investigators. Perhaps the Palestinians would like their own investigators, too.
