I think, besides the mark-to-market rule, the IRS also introduced "substantitively worthless" rule in recent years, where you have to report gains if your short get substantively worthless, like getting de-listed. I never had the luck of shorting something into the absolute zero. I have that irrational fear of manipulated massive short squeeze when the price gets really low.
