I would wager that almost no one wants the spectrum at the prices bid at Auction 35 any more.

Yup. the December deal was the last chance for the government to get even 2/3's of the money. Those in Congress who blocked the deal because they thought the Goverment was getting too little and/or NextWave was getting too much, blew it. Two thirds of the loaf was better than none. Besides the changed market enviroment, spectrum caps are coming off and an auction of 700Mhz is coming someday soon. Worldcom's MMDS spectrum may end up on the market and as you say many carriers are looking for buyers for their surplus spectrum. It's not a seller's market anymore and the FCC will not be able to make the Auction 35 prices stick even if they win their case.
