Cable cos simply have to get the content available. Charter offers VOD in my area but I haven't signed up yet, although I have eagerly anticipated getting it for years. The reason I haven't signed up is Charter has little content and they charge too much for what little they have. Charter is terribly expensive anyway, our rate went way up when Charter bought out the local co that served us, they have had a lot of complaints about their prices in the local Birmingham newspapers.
