I believe the prosecution framed the argument as "was a sawed-off shotgun a military weapon?" It was (trench guns, and Stevens made them for the Army at one time), but no one was there for Miller to assert this and the prosecution let the court believe it was not (and I believe this was unethical to hide truth from the SC). Shotguns were of course deemed military, but somehow they got the court to believe the short ones were not, and were merely weapons for highwaymen or strictly meant for concealment. The SC was pretty deficient to believe this without some research or testimony.
