NEW YORK (Dow Jones)--Merrill Lynch & Co. (MER) and New York state attorney
general Eliot Spitzer, scheduled to appear in court Thursday to discuss
scheduling issues, will likely postpone the proceeding until next week, a
court official said.
Howard Leventhal, a special referee assigned by the judge to supervise the
case, said the proceeding would likely be postponed until next week.
"It looks more likely than not that it won't be held tomorrow because
they're still talking," he said.
A Merrill spokesman confirmed that the proceeding has been postponed, but
declined to comment further. A spokesman for the attorney general couldn't
immediately comment.
This would be the second time the court proceeding has been postponed.
Thursday's meeting was originally scheduled for May 9, but was pushed back
due to what were deemed productive settlement discussions at the time.
The parties are expected to address various scheduling issues, including
depositions of key Merrill employees, when the court proceeding is held.
