But wouldn't a device maker buy a licence from whoever had the technology they wanted? A device doesn't have to be single mode.

They could have GSM, cdma2000, GPRS, W-CDMA, Wi-Fi, Bluetooth, Windows XP and anything else in it, such as my patented Vegemite dispenser and GSRS [TM]. I don't see why somebody should deny them use of any particular technology.
