How can they take his home/cars without a case?

Actually, they haven't, yet. They've been impounded. I believe he can go to court and try to recover them, but it won't be easy.

The RICO statutes were developed to combat organized crime where the defendants used the profits from illegal activities to fund multi-million dollar lifestyles - and defense lawyers. Often, the maximum fines were only a fraction of what these individuals accumulated via illegal activities. RICO statutes were written to take away the "fruits of the crime".

Unfortunately, prosecutors have expanded interpretation of the RICO seizure statutes to a wide range of situations not intended by the statute writers. In a Pennsylvania case, prosecutors seized the home of a retired dentist after police, who responded with firemen to a false fire alarm. noticed 6 pot plants in the poor guy's basement.

Are the seizures justified in this case? The prosecutor obviously thinks Tony accumulated his assets from the profits of illegal activities, hence the seizure.

Is Tony guilty? That's for the courts to decide.

However, for someone who's supposed to be smart he has certainly managed to stumble into a lot of "unusual situations" that might have been easily avoided.

No real opinion here... just trying to clarify that one point.
