I was not present at the hearing. I can envision where it was stated as part of the 'perhaps' sentence after a comma. I can also understand your parsing of the words. Have you read the documents surrounding the sentencing hearing for the mail fraud? He was not convicted of a charity scam, but yet the government brought in witnesses to try to influence the sentencing hearing. I don't believe you need to have a crime that you know you can bring to a conviction in order to bring up a set of circumstances at a sentencing or bail hearing.
