I recall that the FBI was fond of going to public events, such as Vietnam war protests and make a very visible effort of photographing people and writing down little doodles in their notebooks. It was their way of trying to intimidate the participants or their parents.

The new rules allow agents to conduct "general topical research" and "pure surfing" designed to find Web sites, chat rooms or Internet bulletin boards with information about terror, bomb-making instructions, child pornography or stolen credit cards.

The modern equivalent is to make the same public scare announcements about forums such as this. Only a fool would think that at least someone at the FBI didn't monitor threads such as these. The difference now is that Ashcroft want's to intimidate critics by making their surfing much more public and announced.
