You may be correct, but I have insufficient info at this point. As I said in my post, the S.1940 Analysis is probably too brief.

It is recognizing EXPENSE as a result of the grant, which expense occurs after the grant at the time of exercise.

You have made this claim before, but never presented a plausible proof, afaik. I think I posted a counter-claim on this thread, maybe even to you. I don't recall receiving a response.

In brief, I claimed that neither SFAS 123, nor the Black-Scholes eq'n, tries to account for the value of the option at some future time. Both only try to value the option on the grant date. A brief comparison to the use of Black-Scholes in valuing a call option on the open market ought to convince you of my claim.

A subtle fact which the IRS already recognizes

Please show some evidence that the IRS agrees with your claim.

Thanks for the "one of the smarter guys" kudo .. but it wasn't very effective after a couple of insults. "It's good that your shaky understanding is shaken" is insulting, "it's good that your understanding is shaken" is not. "Which most investors (yourself included) don't fully understand" is insulting, "which most investors don't fully understand" is not. You're a smart guy .. I'm sure you appreciate the difference. There is no need for an adversarial discussion about accounting.
