Mary, I think you missed the operative phrase--the last paragraph:

"Breen said that Elgindy had $2 million invested in positions that would have benefited from a market collapse."

Oftentimes I've seen the larger exchange stocks plunge downward while OTC and pink-sheeted stocks stayed stabile or went up. From writing I've read lately on the Elgindy subject, wasn't Elgindy primarily targeting OTC stocks?

It's hard to defend the unknown. The mo-mo, at this point, rests with the charges since the information that led to them is known.
