I would (if deciding the case) clearly limit it to cases where the man knew the woman who conceived the child and where a relationship existed between them, and where insemination of the woman was contemplated by both parties before the death of the man. Thus eliminating the possibility of sperm donors coming under the precedent. It would be easy enough to say explicitly that the decision does not apply to sperm donors.
