<<"open standard">> open to what? all GSM chip and handset manufacturers pay royalty to the cabal. CDMA is adopted by the etsi and iso as a 2g and 3g standards. and it is open to anybody who wants to adopt it, manufacture with it, design with it, a lot of companies tried: NOK, infineon, LSI come to mind. The fact that all essential patents belong to one company does not make it closed.
