Which I have never argued against.

In fact, I supported by the joke example.

But the standard is not whether the person making the agreement intended a contract, but whether the court thinks it's reasonable from their words or actions to find that a contract was formed.

You may be saying in your head "no contract, no contract, I have no intention of making a contract," but there may still be a contract.
