John, I have a lot of respect for Prof. Tribe, but is he not going to far? I come in the door and declare: "I belong to El Quaeda", for me it is a self declaration that I am an "enemy combatant" to the the US. If on top of that, the Government can show that I was trained by El Quaeda, and was given a specific destructive task (assemble and deploy radio/bombs), I am surely an enemy combatant and should be held as a prisoner of war until that specific war (against El Quaeda) was terminated. The only legal problem I see is the lack of a declaration of war by Congress, but Congress was quite clear authorizing the president to use "all necessary and appropriate force . . . to prevent future acts of international terrorism against the United States... ...by those responsible for the attacks of Sept. 11", a double justification, intention to commit terror and belonging to El Quaeda, the organization that is responsible for the 9/11 attack. What is not clear here Prof. Tribe? That American El-Quaeda member belongs with is comrades in arms the prison camp in Cuba.
