Yes, but the supreme court decisions on which the Government justifies its current treatment of US citizen that are also "enemy combatant" relates to declared wars, I am not a historian, but I believe that all other cases are treated as spying or treason and go through the federal courts rather than the military route. It is a legal rather than moral point, yet, we pride ourselves to be a nation abiding by a set of laws, we just cannot brush away our constitution because it is convenient. Let congress declare war on international terrorism and be done with it.

I believe we are getting into a similarly gray area if we indeed invade Iraq, just because we "don't like" their regime, or because they have developed or are developing WMD. We did not invade India and Pakistan when they did exactly the same thing, and frankly, i see a greater danger of Al quaeda getting its hand on some Pakistany WMD, then Iraq's.
