Yes, there's the problem of design by committee, replete with special interest groups, hearings, pork, pomp, etc. Could anything but a lemon ever come out of that? And then there's the problem of timeliness. It takes so long to get legislation passed that by the time a law takes effect, the technology is dated. Nope, picking technology winners and losers is the job of the marketplace.
