"Your "subjectivities" are worse the more complicated the factors in determining the sentence, or the more guess work is involved in what will "work". Punishment is pretty simple, straightforward, and comprehensible......

Huh? I don't think we are understanding each other. What I described is reality. People view there experiences differently. I didn't make that the case, it just is. Since it is, we should view the consequenses of our justice system as just that "consequenses;" consequenses that are designed to bring about desirable results.

The level of punishment one experiences, or not, is largely beyond our control. To intend a particular level of suffering, in and of itself, is in humane. To intend to completely avoid suffering in the process of delivering justice is ludicrous. To intend a particular consequence that brings about a particular result (isolation...may cause one to reflect which may lead to feelings of remorse). Remorsefulness is the trigger to making life changing decisions. The "remorsefulness" is a worthy outcome for us to hope for and so justifies the use of isolation. The isolation is likely to also be experienced as punishing to most participants. So be it. Religious seekers isolate themselves and are greatful for the opportunity to retreat.
