I don't think he should be released either.

I think legally their options at this point where to consider him an enemy combatant or release him. They didn't have quite enough evidence or at least enough evidence that could be used in court (evidence that was neither tainted by being obtained illegally or evidence that would give away vital inteligence sources or techniques if used in court)
