My beef is with the notion that retribution and punishment are not only the the most useful and valid basis for dealing with crime in a society but the only one.

I just started reading, and am impressed with your effort to postulate an alternative, and humane, and possibly more effective, paradigm; but the phrase "crime in a society" struck me as suggesting certain questions.

Societies are different, and have within them differing elements.

"Social opprobrium" may be a deterrent in one society, or subsection of the society, and not much of one in another. For example, the opprobrium of the majority may itself be a badge of honor or sympathy-magnet to a minority. It's a complicated dynamic, and would require intelligence to design the opprobrium scenario so that the object of it wasn't protected from the negative reinforcement which disapproval should provide by a hostile and dysfunctional (from the standpoint of the larger community trying to discourage certain antisocial behaviors) support network.
