That would seem to encourage vigilantism.

1 - Your punishment for the initial crime is low, and so many people may not think that justice has been done and will want to do it themselves.

2 - Your punishment for the vigilante killings are low at least as long as they are first offenses so there is less deterrent from the idea of taking the law in to your own hands.
