I read one report that suggested it wasn't even maintenance costs (which can sometimes be a gray area -- what is maintenance and what is expansion?), but access charges paid to other carriers that were misclassified; I don't see any way that could be anything other than blatant fraud.

But that's JMHO, and certainly not a legal opinion.
