DJ EchoStar/Gemstar -2: Ruling On Three Additional Patents

LITTLETON, Colo. (Dow Jones)--A U.S. District Court ruled EchoStar
Communications Corp. (DISH) didn't infringe on any Gemstar-TV Guide
International Inc. (GMST) products - the second time in two weeks.

In a press release Wednesday, EchoStar said Judge Lacy H. Thornburg in the
Western District of North Carolina ruled that none of EchoStar's current
products infringe any of three additional patents.

Thornburg requested additional information before reaching a final ruling
regarding a low-volume product which is no longer in production.

The patents, asserted by Gemstar and SuperGuide Corp., concern certain
electronic program guide features.

Shares of EchoStar closed Wednesday at $16.04, down 47 cents, or 2.8%, on
Nasdaq volume of 5.7 million shares. Average daily volume is 4.2 million
shares.

On June 25, shares of Gemstar fell sharply to a 52-week low of $4.75 after
the provider of television program guides lost a battle over on-screen program
guide patents.

Shares of Gemstar closed unchanged Wednesday at $5, on Nasdaq volume of 4.1
million shares. Average daily volume is 6.3 million shares.
