the one saving truth is that by the time a product gets to the stage where Intel or AMD can ship engineering samples to their customers, it's really too late to create anything that can counter as an intercept.

Sure, it's too late architecturally but Intel will know how hot it runs, the voltage and power consumption, the frequency headroom and the performance. They'll know how many feature are turned off because of bugs etc and they can then estimate it's arrival in the market place. They can also measure the channel lengths and gate oxides and get insight into the health of AMD's 9 metal layer SOI process.
