Count first and rule upon legality afterwards, is not a recipe for producing election results that have the public acceptance that democratic stability requires."

Scalia assumed the election of Bush Jr. to continue the dynasty of Bush the Elder and then formulated an opinion to bolster the selection of the loser. Nowhere does he address the harm to the winner of the election, Al Gore. In return Bush Jr. promised to give Scalia's progeny high government access and privelige.
