Protecting the minority and letting the minority make the rules are two different things. When courts deviate too far from the norm they subject themselves to ridicule, scorn and worse.

I am not the lock-step rightwinger you might suppose but I do believe strongly in the value of sacrificing a degree of personal interest for the common interest. Everyone can't have it their way.

Our courts are too valuable to be trivialized by ultra-individualists, rapacious trial lawyers or an imperial judiciary. The courts walk a fine line in a democracy.

The Ninth Circuit, IMO, is on the far side of the line. I was surprised last night to hear that Justice Rheinhardt's wife is the head of the Northern CA ACLU. She's probably the mainstream thinker in the family.....
