I agree with you the FBI crossed the line when they label Tony as a terrorist with foreknowledge of the 9/11 event without charging him as such. If anything at all, I won't be surprise if they find him guilty of all charges except this one.
But again, we all know the government loves to make deal if Tony turns into an informant/witness and testifies against others. Tony can pretty much walk with a small slap on the wrist if he turns others in for his own gain. Think of this like a five-ring target practice with Tony as a center bull-eye. The next closest ring to Tony are a few inner circle people who knew and helped him with the enterprise. The next ring of the target are members of his website who profited from his illegal activities. Then come the brokerage/securities firms, market makers, reporters, brokers, who helped Tony as well as profited from his illegal activities. The last of the ring are the sheeps who paid $600 a month and did not profited from Tony's illegal calls. The FBI are not interested in hanging these sheeps to dry, they may get a subpoena from the FBI asking questions, but the FBI are more interest in finding out anything these people knew, to help them fry the bigger fishes of the bigger rings 1,2,3,4 as described.
In any case, Tony had tendency of selling out on others for his own gain in the past. I don't see why it should be anything different this time. If you are part of the Enterprise and belong to either ring 1,2,3, or 4, I will be very surprise if you are not under the watchful eyes of the FBI. IMO, it should be just a matter of time before you get a knock on your door.
