I believe a main characteristic of UIT's is passive management as opposed to a mutual fund or an active managed fund. Most UIT's spell out in the prospectus the proposed portfolio. Remember Warren Buffett recently tried to head off BRK UIT's. Are you talking about setting up one trust for each investment? Better keep youre eye on the basket! Youre right about the 35/99 rule, additionally everyone must reside in the same state. Keep in mind there are 50 state securities laws to comply with.The way to do it is in the form of a private investment partnership. Take youre 35 non-accredited investors, and then take 5 additional with a entry level of 250K, then take the next five or ten or whatever at 500k until you fill it up. Raise the minimums as you run out of slots. If you build a track record you shouldn't have a problem funding a second vehicle.
