Mom: Daughter In Pledge Case Saddened By Ruling
Girl Reportedly Says She's Not Athiest

SAN FRANCISCO -- The mother of the California schoolgirl in the Pledge of Allegiance case says the girl has not been harmed by reciting the declaration.



Sandra Banning, who has full custody of the third-grader, says her daughter "expressed sadness" after a federal appeals panel agreed with her father that the pledge is unconstitutional because it includes the words "under God."

Banning says she doesn't want people to think her daughter is an atheist.


The ruling was based in part on Michael Newdow's contention that his daughter was "injured" by being forced to listen to others recite the pledge.

Asked about Banning's statement there's been no injury, Newdow said he's the injured party. He insists he has the right to send his child to a public school without religious dogma.

Some legal experts say if the girl willingly recites the pledge, that could hurt her father's case.
