I don't agree with you. If someone had taken Bush to court, the SEC decision not to pursue the matter further would have been evidence in his favor. It is an exoneration. The alternative is to say that ALL parties investigated by the SEC are guilty by the mere fact of investigation, since the agency does not issue letters of exoneration.
